WithfileTerms of service
These terms govern your use of Withfile (withfile.atesensoftware.com), provided by Samet Ateşen, trading as Atesen Software, Sakarya, Türkiye ("we"). By using Withfile or buying a license you accept them.
1. What Withfile does
Withfile is browser software for withholding agents that file Form 1042-S. It reads files you provide (IRS Publication 1187 files made for the FIRE system, or CSV/XLSX files in the IRIS Form 1042-S template layout), applies checks and clean-ups based on Publication 1187, Publication 5717, the Instructions for Form 1042-S and the IRS IRIS CSV template formatting guidelines, and builds CSV files for upload to the IRIS Taxpayer Portal together with a review workbook. Withfile does not transmit anything to the IRS; you upload the files yourself.
2. Free use and licenses
- Checking files and viewing the results on screen, and downloading the files built from the made-up sample, are free.
- A license unlocks downloading the CSV files and review workbook built from your own data for 12 months from the purchase date. Agent: 1 withholding agent EIN. Group: up to 10 withholding agent EINs. Firm: unlimited withholding agent EINs.
- Licenses are for use by your organisation's personnel and may not be resold, shared outside your organisation or published.
3. Payment
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Prices are shown in USD. Where VAT or sales tax applies, Paddle calculates it and shows the total before you pay. Licenses are one-time payments covering 12 months and do not renew automatically.
4. Your responsibility
Withfile formats and checks data you provide. It is not tax or legal advice: it does not decide what must be reported, which income code, status code, exemption code or treaty rate applies, or whether documentation (Forms W-8, W-9) supports a rate. The IRS can reject or question returns for reasons Withfile cannot check. You remain responsible for reviewing the files and the issues list, for your IRS filing, your Form 1042 and for meeting deadlines.
5. Availability and changes
We may improve, change or discontinue features. A license keeps its download access for its 12-month term, including updates for IRIS template changes published in that term. Files you downloaded remain yours.
6. Liability
To the extent the law allows, our total liability for any claim relating to Withfile is limited to the amount you paid for the license in the 12 months before the claim. We are not liable for indirect or consequential loss, including penalties imposed by a tax authority or lost profit. Nothing in these terms limits liability that cannot be limited by law.
